2. Purpose
These general conditions of use (CGU) define the rules for access and use of the Site.
The purpose of the Site is to present PG Management, its areas of activity and its services, particularly in terms of AI consulting, AI agents, AI employees, automation, AI training and support for SMEs in French-speaking Switzerland. The descriptions published on the Site have a primarily informative and marketing function.
3. Acceptance
By accessing or using the Site, you accept these T&Cs.
When you contact us, request an audit, request an offer, book an exchange or send us information by form, e-mail or any other means, you also accept the specific rules applicable to these procedures. In Swiss law, the scope of standard conditions is assessed according to their integration into the contractual relationship and according to good faith.
4. Access to the Site
Access to the Site is in principle free, excluding connection and telecommunications costs borne by your own operator.
We strive to ensure reliable access to the Site, without guaranteeing continuous availability, without interruption or error. We may suspend, limit, modify or interrupt all or part of the Site at any time, in particular for technical, maintenance, security, service development or content updating reasons.
5. Nature of information published
The information appearing on the Site, in particular relating to services, use cases, expected results, deadlines, methods, examples, indicative costs, business benefits, ROI, deployment or compatibility with certain tools, is provided for information purposes only.
Unless expressly stated otherwise, the content of the Site does not constitute a firm offer, nor a contractual guarantee of results, nor a commitment on a price, a deadline or a specific deliverable. The services, prices, deadlines, scope, responsibilities and execution methods are set out on a case-by-case basis in an offer, a quote, a purchase order, a contract or a separate mandate. This distinction also corresponds to the structure already announced on the current page of the general conditions.
6. Contact and requests via the Site
The Site may allow you to contact us, request an AI audit, request an offer or send us information about your business and your needs.
You agree to provide accurate, complete, current and lawful information. You agree not to transmit false, misleading, illicit, malicious, confidential data without authorization or infringing the rights of third parties. The forms visible on the site ask for name, email, telephone, company, subject and message.
7. Lack of legal, tax or regulatory advice
Unless otherwise agreed in writing, the content of the Site and the first exchanges via the Site do not constitute legal, tax, accounting, regulatory or compliance advice within the meaning of a specialized mandate.
The information made available on the Site aims to present approaches, use cases, expertise and support methods around AI and automation for SMEs. Any legal, regulatory, security or compliance validation must be assessed within the framework of a specific mandate or with competent professionals.
8. Intellectual property
The Site, its structure, its design, its texts, visuals, logos, brand, content bases, documentation, presentation pages, guides, use cases and technical elements are protected by intellectual property rights and belong to PG Management or its partners/licensees, unless otherwise indicated.
Any reproduction, adaptation, extraction, distribution, republication, making available, representation or exploitation, total or partial, without our prior written authorization, is prohibited, except within the limits provided by law. The current general conditions page already mentions this protection of principle.
9. Prohibited use
You agree not to:
- use the Site for illicit, fraudulent or abusive purposes;
- disrupt the operation of the Site or attempt to access it in an unauthorized manner;
- introduce viruses, scripts or malicious code;
- massively vacuum the contents of the Site by scraping or automated means without authorization;
- infringe our rights, those of other users or third parties.
10. Third Party Links and Services
The Site may contain links to third-party services, including social networks, external tools, integrated content, contact platforms or analysis services.
We have no control over the content, availability, security, or practices of these third-party services. Their use is at your own discretion and on their own terms. The site's current privacy policy already mentions that statistics, third-party forms or embedded content may apply their own rules.
11. Pre-contractual discussions and offers
Any discussion initiated via the Site, including an audit request, an exploratory exchange or making contact, does not in itself create an obligation to conclude a contract.
Unless otherwise agreed in writing, a mandate is only concluded when the parties have agreed on the essential elements of the service, in particular its purpose, scope, remuneration and main terms. Under Swiss law, the contract is formed when the parties have mutually expressed their will on the essential points.
12. Liability
We are liable for damage caused intentionally or through gross negligence, in accordance with Swiss law.
Within the limits permitted by law, we exclude all liability for indirect or consequential damages, loss of profits, operating losses, loss of savings, loss of data, unavailability of the Site, technical incompatibilities, content errors, decisions taken solely on the basis of information from the Site, as well as for the acts or omissions of third parties. Under Swiss law, a prior exemption clause for fraud or serious misconduct is void, which is why this reservation must be expressly maintained.
13. Data protection
The processing of personal data carried out via the Site is governed by our Privacy Policy.
14. Modification of the T&Cs
We may modify these T&Cs at any time. The applicable version is that published on the Site at the time of your consultation or use, subject to a different express agreement in a particular contractual framework.
The need to make standard clauses transparent and predictable is part of the requirement of good faith and the case law relating to general conditions.
15. Partial nullity
If a provision of these T&Cs should be deemed void, invalid or inapplicable, the other provisions remain valid.
16. Applicable law and forum
These T&Cs are subject to Swiss law.
Subject to the mandatory forums provided for by law, any dispute relating to the Site or these T&Cs falls under the jurisdiction of the competent courts at the headquarters of PG Management Ltd. A forum clause must remain compatible with the applicable mandatory rules; generally speaking, general conditions that are too aggressive or unusual can be excluded.
